LMIA Process in Canada
Navigating Labour Market Assessment Requirements
The LMIA process is primarily an employer-driven process. Employers must meet specific requirements before hiring a temporary foreign worker.
If a positive LMIA is issued, the foreign worker may then be able to use the required documents to apply for a work permit.

The LMIA Process Steps
The Labour Market Impact Assessment process typically involves the following key stages:
- Identifying a genuine job position and employment need.
- Meeting recruitment and advertising requirements, where applicable.
- Offering wages and working conditions that meet the applicable requirements.
- Preparing the required employer documentation.
- Submitting the LMIA application to Employment and Social Development Canada (ESDC).
- Responding to any additional requests from the authorities.
- Receiving a decision on the LMIA application.
LMIA Requirements for Employers
Canadian employers must demonstrate that they meet the requirements of the applicable LMIA stream.
Requirements can vary depending on the occupation, wage level and location of the position.
Employers may need to demonstrate that they have made reasonable efforts to recruit Canadians or permanent residents before seeking to hire a foreign worker.
They may also need to provide information about the business, the position, wages, recruitment activities and working conditions.
Because LMIA requirements can vary, employers should ensure that their application is prepared according to the current requirements of the applicable program.
LMIA and Work Permits
An LMIA and a work permit are not the same thing.
The LMIA process is generally completed by the Canadian employer, while the foreign worker is responsible for applying for the appropriate work permit.
A positive LMIA can support a worker's work permit application when an LMIA is required. The worker must still meet the eligibility requirements for a Canadian work permit.
Obtaining a positive LMIA does not automatically guarantee that a work permit application will be approved.
